TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern the relationship between Mark US Global Consultancy (“the Company,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Scope of Services
Mark US Global Consultancy provides professional advice, documentation assistance, and application processing support for various visa categories (e.g., USA, Schengen, UK).
We act strictly as consultants. We provide guidance based on current immigration laws and policies.
We do not issue visas. We are not an embassy, consulate, or government body.
2. No Guarantee of Visa Issuance
Sole Discretion: The power to grant or refuse a visa lies solely with the respective Government and its Consular Officers.
Outcome: We do not guarantee the success of any visa application. A rejection by an embassy does not constitute a failure of our service, as the final decision is outside our control.
Timelines: Processing times provided by us are estimates based on embassy averages. We are not liable for any delays caused by the embassy or third-party services (e.g., VFS Global, courier services).
3. Client Responsibilities
The success of an application depends heavily on the Client. You agree to:
Honesty: Provide 100% accurate, truthful, and complete information. Submission of fraudulent documents or “fake” bank statements will lead to immediate termination of our contract without a refund.
Deadlines: Provide all requested documents within the timeframes specified by your consultant.
Communication: Notify us immediately of any changes in your personal circumstances (e.g., job change, marriage, or legal issues).
4. Fees and Payment
Professional Fees: Our service fees cover our time, expertise, and administrative costs. These are separate from Embassy Fees and VFS/Gerry’s Fees.
Third-Party Costs: You are responsible for paying all government fees, translation costs, and medical insurance directly to the relevant authorities unless otherwise agreed in writing.
Payment Terms: Services will only commence once the agreed-upon initial payment has been received.
5. Refund and Cancellation Policy
General Rule: Our professional fees are Non-Refundable once the consultation has begun or the document checklist has been shared.
Visa Rejection: No refunds will be issued in the event of a visa refusal, as our fee is for the service provided (preparation and filing), not the result.
Force Majeure: We are not liable for refunds if an application cannot proceed due to changes in international law, border closures, or “Acts of God.”
6. Limitation of Liability
To the maximum extent permitted by Pakistani law, Mark Us Global Consultancy shall not be liable for any direct, indirect, or consequential loss (including loss of airfare, hotel bookings, or business opportunities) resulting from a visa delay or rejection.
We are not responsible for the loss of original documents by third-party couriers or embassy staff.
7. Document Handling
While we take the utmost care of your documents, we recommend that clients only provide copies unless the embassy specifically requires originals.
Any original documents left in our possession for more than 30 days after the conclusion of a case will be handled according to our data disposal policy.
8. Termination of Service
We reserve the right to terminate our services immediately if:
The Client provides false information.
The Client is abusive toward our staff.
The Client fails to make payments as agreed.
9. Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Karachi.
